{"id":13254,"date":"2026-06-28T09:29:00","date_gmt":"2026-06-28T06:29:00","guid":{"rendered":"https:\/\/en.tomanifesto.gr\/?p=13254"},"modified":"2026-06-28T09:29:00","modified_gmt":"2026-06-28T06:29:00","slug":"private-debt-what-the-new-law-means-for-borrowers-small-debtors-and-businesses","status":"publish","type":"post","link":"https:\/\/en.tomanifesto.gr\/?p=13254","title":{"rendered":"Private Debt: What the New Law Means for Borrowers, Small Debtors, and Businesses"},"content":{"rendered":"<p data-start=\"1620\" data-end=\"1935\">     The new <strong data-start=\"1645\" data-end=\"1656\">framework<\/strong> for <strong data-start=\"1664\" data-end=\"1682\">private debt<\/strong> is now in effect, following the passage of the relevant law by Parliament. The <b>Ministry of National Economy and Finance <\/b>is moving forward with a package of measures that changes the way debts are handled, both with respect to the government and to banks and servicers. <\/p>\n<p data-start=\"1937\" data-end=\"2284\">     The new regulations concern court rulings under the former <strong data-start=\"1998\" data-end=\"2015\">Katseli Law<\/strong>, the <strong data-start=\"2021\" data-end=\"2047\">out-of-court mechanism<\/strong>, the <strong data-start=\"2053\" data-end=\"2066\">72-installment plan<\/strong> for debts owed to the government, the limits of the <strong data-start=\"2105\" data-end=\"2120\">exemption from seizure<\/strong>, as well as the protection of the <strong data-start=\"2149\" data-end=\"2169\">primary residence<\/strong>. According to the ministry, more than <strong data-start=\"2213\" data-end=\"2238\">2 million citizens<\/strong> are estimated to be affected by the changes. <\/p>\n<p data-start=\"2286\" data-end=\"2358\">     Minister Kyriakos Pierrakakis, in a statement to the Athens-Macedonian News Agency (ANA-MPA), said:<b> \u201cPrivate debt is perhaps the most complex social consequence of the crisis. It is measured in insecurity, in delayed life decisions, in people who feel that the past continues to determine their future.<\/b>\u201d <\/p>\n<p>     He added: \u201c<b>Our job is to break this vicious cycle with solutions that create real second chances. Every action we take regarding private debt serves the obligation to reduce burdens, restore potential, and offer new horizons. The true success of economic policy is measured by the number of citizens who feel they are regaining control of their lives. And that is, ultimately, the most meaningful form of progress for society.<\/b>\u201d <\/p>\n<h2 data-section-id=\"4jrma5\" data-start=\"3094\" data-end=\"3148\">     <strong data-start=\"3097\" data-end=\"3148\">The seven key changes brought about by the new law<\/strong> <\/h2>\n<h3 data-section-id=\"1a5moz5\" data-start=\"3150\" data-end=\"3224\">     <strong data-start=\"3154\" data-end=\"3224\">1. Interest rates on court-approved repayment plans under the Katseli Law are being reduced<\/strong> <\/h3>\n<p data-start=\"3226\" data-end=\"3330\">     The most significant change affects those with active court-approved repayment plans under the former <strong data-start=\"3312\" data-end=\"3329\">Katselis Law<\/strong>. <\/p>\n<p data-start=\"3332\" data-end=\"3516\">     From now on, <strong data-start=\"3341\" data-end=\"3350\">interest<\/strong> will be calculated only on the <strong data-start=\"3382\" data-end=\"3398\">monthly installment<\/strong> and not on the total outstanding balance of the debt. This significantly reduces the total cost of servicing the loans. <\/p>\n<p data-start=\"3518\" data-end=\"3765\">     At the same time, the new regulation also has <strong data-start=\"3552\" data-end=\"3571\">retroactive effect<\/strong> on active cases. Any excess amounts already paid as interest will be offset against the final installments, allowing many borrowers to complete their repayment earlier. <\/p>\n<h3 data-section-id=\"q918q3\" data-start=\"3772\" data-end=\"3845\">     <strong data-start=\"3776\" data-end=\"3845\">2. The method for calculating installments under other debt relief programs is \u201clocked in\u201d<\/strong> <\/h3>\n<p data-start=\"3847\" data-end=\"4054\">     For those who have entered into other debt settlement arrangements, such as through the <strong data-start=\"3913\" data-end=\"3941\">out-of-court mechanism<\/strong> or Law 4605\/2019, the monthly installment will no longer be subject to additional interest or recalculation. <\/p>\n<p data-start=\"4056\" data-end=\"4156\">     This provision applies retroactively as of <strong data-start=\"4098\" data-end=\"4118\">April 1, 2019<\/strong> and affects tens of thousands of debtors. <\/p>\n<h3 data-section-id=\"1sj373k\" data-start=\"4163\" data-end=\"4224\">     <strong data-start=\"4167\" data-end=\"4224\">3. New payment plan of up to 72 installments for debts owed to the government<\/strong> <\/h3>\n<p data-start=\"4226\" data-end=\"4327\">     The new law introduces an emergency <strong data-start=\"4255\" data-end=\"4280\">payment plan of up to 72 installments<\/strong> for debts owed to the <strong data-start=\"4302\" data-end=\"4310\">AADE<\/strong> and the <strong data-start=\"4318\" data-end=\"4326\">KEEO<\/strong>. <\/p>\n<p data-start=\"4329\" data-end=\"4466\">     This option applies to debts incurred up to <strong data-start=\"4380\" data-end=\"4402\">December 31, 2023<\/strong> and were not subject to an active payment plan as of <strong data-start=\"4445\" data-end=\"4465\">April 21, 2026<\/strong>. <\/p>\n<p data-start=\"4468\" data-end=\"4648\">     Applications will be submitted electronically, and the repayment plan will take effect upon payment of the first installment. Enrollment will remain open until <strong data-start=\"4625\" data-end=\"4647\">December 31, 2026<\/strong>. <\/p>\n<h3 data-section-id=\"6hh4me\" data-start=\"4655\" data-end=\"4720\">     <strong data-start=\"4659\" data-end=\"4720\">4. The exemption from seizure for bank accounts is increasing<\/strong> <\/h3>\n<p data-start=\"4722\" data-end=\"4809\">     After about ten years, the <strong data-start=\"4764\" data-end=\"4783\">exemption limit<\/strong> for debts owed to the government is increasing. <\/p>\n<p data-start=\"4811\" data-end=\"4875\">     The threshold is rising from <strong data-start=\"4833\" data-end=\"4847\">1,250 euros<\/strong> to <strong data-start=\"4851\" data-end=\"4865\">1,600 euros<\/strong> per month. <\/p>\n<p data-start=\"4877\" data-end=\"4954\">     At the same time, for debts owed to private individuals and banks, the exemption is set as follows: <\/p>\n<ul data-start=\"4956\" data-end=\"5043\">\n<li data-section-id=\"2uhw8e\" data-start=\"4956\" data-end=\"5000\"><strong data-start=\"4958\" data-end=\"4972\">1,600 euros<\/strong> for individual accounts.<\/li>\n<li data-section-id=\"ewrl19\" data-start=\"5001\" data-end=\"5043\"><strong data-start=\"5003\" data-end=\"5017\">2,200 euros<\/strong> for joint accounts.<\/li>\n<\/ul>\n<h3 data-section-id=\"15ds5f9\" data-start=\"5050\" data-end=\"5108\">     <strong data-start=\"5054\" data-end=\"5108\">5. Lifting of seizure upon payment of 25% of the debt<\/strong> <\/h3>\n<p data-start=\"5110\" data-end=\"5313\">     For the first time, the option is introduced for the full <strong data-start=\"5157\" data-end=\"5200\">lift the attachment of bank accounts<\/strong>, provided that the debtor pays at least <strong data-start=\"5246\" data-end=\"5253\">25%<\/strong> of the debt for which the enforcement measures were imposed. <\/p>\n<p data-start=\"5315\" data-end=\"5379\">     This option will be available <strong data-start=\"5344\" data-end=\"5361\">only once<\/strong> to each debtor. <\/p>\n<h3 data-section-id=\"1coy3i\" data-start=\"5386\" data-end=\"5444\">     <strong data-start=\"5390\" data-end=\"5444\">6. Out-of-court mechanism also for smaller debts<\/strong> <\/h3>\n<p data-start=\"5446\" data-end=\"5511\">     Access to the <strong data-start=\"5484\" data-end=\"5510\">out-of-court mechanism<\/strong>. <\/p>\n<p data-start=\"5513\" data-end=\"5662\">     The minimum debt threshold is being lowered from <strong data-start=\"5552\" data-end=\"5567\">10,000 euros<\/strong> to <strong data-start=\"5573\" data-end=\"5587\">5,000 euros<\/strong>, allowing more small debtors to participate in the process. <\/p>\n<p data-start=\"5664\" data-end=\"5696\">     The arrangements may include: <\/p>\n<ul data-start=\"5698\" data-end=\"5809\">\n<li data-section-id=\"1lt3mwa\" data-start=\"5698\" data-end=\"5747\">up to <strong data-start=\"5704\" data-end=\"5718\">240 installments<\/strong> for debts owed to the government,<\/li>\n<li data-section-id=\"1bwiptq\" data-start=\"5748\" data-end=\"5809\">up to <strong data-start=\"5754\" data-end=\"5768\">420 installments<\/strong> for debts owed to financial institutions.<\/li>\n<\/ul>\n<p data-start=\"5811\" data-end=\"5861\">     The measure is expected to take effect in late July. <\/p>\n<h3 data-section-id=\"uxx2cf\" data-start=\"5868\" data-end=\"5932\">     <strong data-start=\"5872\" data-end=\"5932\">7. Protection of the primary residence through out-of-court proceedings<\/strong> <\/h3>\n<p data-start=\"5934\" data-end=\"6055\">     For the first time, a special provision is introduced to protect the <strong data-start=\"5994\" data-end=\"6014\">primary residence<\/strong> through the <strong data-start=\"6028\" data-end=\"6054\">out-of-court mechanism<\/strong>. <\/p>\n<p data-start=\"6057\" data-end=\"6239\">     The debtor will be able to exclude their primary residence from the liquidation process and propose the sale of other assets, such as a plot of land or a second property. <\/p>\n<p data-start=\"6241\" data-end=\"6439\" data-is-last-node=\"\" data-is-only-node=\"\">     In this way, they may be able to secure a more favorable agreement, a larger <strong data-start=\"6315\" data-end=\"6326\">debt reduction<\/strong> and lower monthly payments, while this option is expected to become available in <strong data-start=\"6424\" data-end=\"6438\">September<\/strong>. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>\n    The new framework for private debt is taking effect following the passage of the relevant law by Parliament.
