of <strong data-start=\"260\" data-end=\"294\">conscious scandalology<\/strong>, which on the one hand is causing understandable trouble for the mystics of the law, I mean <strong data-start=\"372\" data-end=\"386\">lawyers<\/strong>, and on the other hand it satisfies the pious ego of the conspiracy theorists and toxic scandal-mongers, who are the first to set the stone against the alleged names involved in the newly filed lawsuits, related indirectly or directly to the underlying case of <strong data-start=\"656\" data-end=\"667\">OPEKEPE<\/strong>.<\/p>\n<p data-start=\"672\" data-end=\"984\">It is obvious that the <strong data-start=\"693\" data-end=\"715\">legal civilization<\/strong> is based on the highly formal <strong data-start=\"759\" data-end=\"780\">Charter<\/strong>, which is, of necessity, the <strong data-start=\"821\" data-end=\"833\">Constitution<\/strong>, as well as the <strong data-start=\"854\" data-end=\"881\">judicial rules<\/strong> of the European Convention on Human Rights (ECHR) and the <strong data-start=\"962\" data-end=\"981\">Union law<\/strong> in force.<\/p>\n<p data-start=\"986\" data-end=\"1621\">In particular, <strong data-start=\"1005\" data-end=\"1017\">Article 26<\/strong> is relevant to the <strong data-start=\"1044\" data-end=\"1069\">distinction of powers<\/strong> into legislative, executive and judicial, the distinction of which in no way includes that of <strong data-start=\"1169\" data-end=\"1176\">the media<\/strong>, our beloved television, which tends to take precedence and become &#8220;the king&#8217;s queen&#8221;, by substituting itself for the <strong data-start=\"1307\" data-end=\"1345\">prosecutorial and investigative authorities<\/strong>, causing on the one hand an over-exaggerated <strong data-start=\"1383\" data-end=\"1394\">confusion<\/strong> in public opinion, obscuring the truth and, on the other hand, deafening fundamental <strong data-start=\"1493\" data-end=\"1527\">procedural safeguards<\/strong>, as a result of the <strong data-start=\"1542\" data-end=\"1561\">State of Law<\/strong>, with the result that <strong data-start=\"1580\" data-end=\"1618\">the MP in question is disgraced<\/strong>.<\/p>\n<p data-start=\"1623\" data-end=\"2288\">For example, passages from the case file are made public, which is <strong data-start=\"1687\" data-end=\"1699\">illegal<\/strong>, and on top of that the self-appointed &#8220;tele-interrogators&#8221;, &#8220;tele-inspectors&#8221; and &#8220;tele-judges&#8221; draw conclusions from the questions put to the accused MPs as unproven, given that they lack <strong data-start=\"1913\" data-end=\"1935\">institutional guarantees<\/strong> and <strong data-start=\"1944\" data-end=\"1960\">jurisdiction<\/strong>, as they do not in any way cover all the stages of the case-file, with the result that <strong data-start=\"2075\" data-end=\"2098\">unfounded impressions<\/strong> are created and <strong data-start=\"2119\" data-end=\"2145\">false assurances<\/strong> of certain persons are created in public opinion, in a manner manifestly contrary to the institution of the <strong data-start=\"2232\" data-end=\"2259\">presumption of innocence<\/strong> under Article 72 of the <strong data-start=\"2278\" data-end=\"2285\">Criminal Procedure Code<\/strong>.<\/p>\n<p data-start=\"2290\" data-end=\"2795\">With the consequence that it is subsequently consolidated in common thought that the Member concerned is already <strong data-start=\"2383\" data-end=\"2393\">guilty<\/strong>, at a time when it is true that the adoption of the <strong data-start=\"2455\" data-end=\"2482\">waiver or waiver of immunity<\/strong> under Article 56 of the CCP merely gives permission to circumvent Articles <strong data-start=\"2547\" data-end=\"2576\">61 and 62 of the Constitution<\/strong>, in order to carry out the <strong data-start=\"2600\" data-end=\"2623\">investigatory acts<\/strong> in the context of the preliminary investigation under Articles 243 and 244 of the CCP, in order to ascertain whether or not there is sufficient evidence of the alleged offence.<\/p>\n<p data-start=\"2797\" data-end=\"3054\">so that, if and when they do exist, criminal proceedings may be brought<\/strong>, in which case, and only then, the status of <strong data-start=\"2921\" data-end=\"2939\">a defendant<\/strong> under Article 72 of the CCP is acquired, and the person prosecuted ceases to be a <strong data-start=\"3010\" data-end=\"3021\">subordinate<\/strong> under Article 244(1)(b) of the CCP. 1 of the CPC.<\/p>\n<p data-start=\"3056\" data-end=\"3405\">But apart from the legal aspect, which is suppressed and denied in the case of <strong data-start=\"3132\" data-end=\"3151\">pressure tactics<\/strong> by the media, the protective scope of <strong data-start=\"3236\" data-end=\"3265\">Article 62 of the Constitution<\/strong> is further eliminated from the discussion, in relation to the existence of the <strong data-start=\"3296\" data-end=\"3320\">immunity of a Member of Parliament<\/strong> who is alleged to have committed a criminal offence in the performance of his duties.<\/p>\n<p data-start=\"3407\" data-end=\"3609\">The provision in question protects the MP from any <strong data-start=\"3462\" data-end=\"3504\">attempted politically motivated prosecution<\/strong>, hence this protection constitutes a kind of &#8220;police protection&#8221; as a <strong data-start=\"3579\" data-end=\"3606\">representative of the nation<\/strong>.<\/p>\n<p data-start=\"3611\" data-end=\"3875\">Therefore, in order to waive his immunity, it is required that the MP concerned, before expressing his uncontrolled <strong data-start=\"3740\" data-end=\"3762\">conscientious judgment<\/strong> through his vote, must thoroughly examine whether the alleged offence is closely connected with the performance of his duties or not.<\/p>\n<p data-start=\"3877\" data-end=\"4117\">Therefore, the body of the <strong data-start=\"3911\" data-end=\"3921\">Parliament<\/strong> must thoroughly sift through the respective file as case by case and by distinction before the Parliament for <strong data-start=\"4040\" data-end=\"4065\">waiver or not of immunity<\/strong>, having regard to the above provisions.<\/p>\n<p data-start=\"4119\" data-end=\"4459\">This is a <strong data-start=\"4170\" data-end=\"4205\">procedural guarantee of transparency<\/strong>, for the justifiably correct interpretation of Article 62 of the Constitution, in conjunction with <strong data-start=\"4294\" data-end=\"4306\">Article 20<\/strong> on the right to judicial protection and <strong data-start=\"4352\" data-end=\"4370\">Article 4 para. 2<\/strong> on equality, in relation, finally, to the contested <strong data-start=\"4422\" data-end=\"4456\">waiver of the immunity of Members of Parliament<\/strong>.<\/p>\n<p data-start=\"4461\" data-end=\"4795\">In conclusion, <strong data-start=\"4478\" data-end=\"4515\">in-depth legal thought and analysis<\/strong> is intended to be the tool for the proper manifestation of <strong data-start=\"4573\" data-end=\"4607\">conscientious voting<\/strong>, taking into account the aforementioned legal considerations and problems concerning the correct interpretation and application of Article 62 of the Constitution, so that they do not fall prey to the <strong data-start=\"4775\" data-end=\"4792\">&#8220;telecourts&#8221;<\/strong>.<\/p>\n<p data-start=\"4797\" data-end=\"4902\" data-is-last-node=\"\" data-is-only-node=\"\"><em data-start=\"4797\" data-end=\"4902\" data-is-last-node=\"\">*Haralambos B.
