Intervention by Giannis Androulakis<\/b> on the occasion of the decision of the prosecutor of the Supreme Court<\/b> not to withdraw the wiretapping case from the file.<\/p>\n<\/p>\n

Commenting, in a post, on the noise raised after the ruling and the direct shots against Justice, Yannis Androulakis stresses that “caution is needed in public denunciatory speech<\/b>, especially when the person who makes it reserves for himself the role of guardian and guarantor of the institutions. Even more caution is needed when he asks for the trust of the people to govern the country<\/b>.”<\/p>\n

He stresses with regard to the process and substance of making decision of the Supreme Court that everything is “well done”.<\/p>\n

He notes in his post:<\/p>\n

“The withdrawal of a case file<\/b> from the archives is not an ordinary case. And it is not, because filing a case file is a more painful task than rushing it to the next stage of prosecution. For the latter, it is sufficient for the prosecutor to reiterate the view of the person who has appealed an offence or caused the preliminary criminal investigation. However, in order to decide that there is no need for further investigation, he must give adequate and thorough reasons for his order. For this very reason, that is, because the Orders by which a case file enters the file are usually adequately reasoned, it is not easy to “retract” it just because any factor influential in public opinion insists on it.<\/b> Especially when the insistence is based solely on information coming from a man who was convicted of wiretapping and later incriminated himself for the crime of espionage. <\/p>\n

Summary: (a) correctly the Single Judge of the Magistrate’s Court forwarded the transcripts of the Interception trial for further investigation,<\/b> in order to determine whether the offence of espionage has been committed, b) correctly assigned to the Deputy Prosecutor of the Supreme Court<\/b>; c) correctly filed<\/b> as the reason for filing is fully justified; d) how the Prosecutor of the Supreme Court confirmed the Order of his subordinate.<\/b> In short, all well done.<\/p>\n

Care is needed in public denunciatory speech, especially when the person making it reserves to himself the role of custodian and guarantor of the institutions. Even more caution is needed when he asks for the trust of the people to govern the country.”<\/p>\n
