Much more so, in a favoured state and in a modern democracy such as the Greek one. And yet: even political leaders lambast judges and directly accuse them of being in cahoots with the government or, at best, of carrying out orders from above.

We saw it, after all, recently and we are seeing it again: in the case of the Tempi tragedy, the judiciary – according to the same people – was following the government’s instructions. But in the case of the observations, it was Justice that would lead the way and “clean up” the case.

So it is not surprising that now the same political leaders and the same political leaders declare their confidence in Justice for … the Tempi and want the trial to be completed soon and without obstacles, but they are skimming against top judges on the occasion of the decision of the Supreme Court to keep the surveillance case on file.

Selective sensitivity that is, but at the same time … asshole, without shame and without any other explanation. Because all they care about is serving and serving their own political narrative against the government, especially since they are unable to articulate a serious and programmatic oppositional discourse. Here’s the paradox: the district judges who reviewed the wiretapping case and proceeded to hand down multi-year sentences to the private citizens who were defendants in the case are… good for these politicians.

At the same time, however, the supreme court justices who decided not to withdraw the case from the record, despite the trial court’s ruling, are… evil and treacherous. They supposedly serve the government or are motivated by it. They succumb to interference and play – as they claim – political games. But how is it possible for this to happen, and at a high level, while at the same time at the level of the primary judge they are all unconstrained? Moreover, before we even get to this point, there is another principle that is respected by almost all of the political world in all favoured nations: we never comment on decisions of the judiciary. Or, to be more precise, we have the right to express our opinion, but we cannot express an opinion on the judges’ judgement. Not because someone tells us so as a matter of statute, but because that is what the constitutional protection of judicial independence requires. In other words, what is happening in the country right now with the opposition’s attitude is nothing but an attempt – conscious or otherwise – to deconstruct one of the pillars of the democratic constitution, contrary to the dictates of the constitution.

The reality is that the decision of the Supreme Court prosecutor not to withdraw the wiretapping case from the file belies the expectations of PASOK and other opposition parties and certainly Nikos Androulakis personally.

And it is perfectly understandable that this is extremely unpleasant for them in an election period, however it would be good for them to first realize the reality as soon as possible. And to avoid, of course, attacks on the judiciary and especially personal attacks on specific judges, because this undermines the very democracy they say they are defending against the government that they claim is… destroying the institutions

Trust in the judiciary is far from suspicious of it, and that is a given.
By Ersi Papadakis
We all know each other, after all, in…

[1

post-3171","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-uncategorized
["GET
