and ‘corrupt’ by telephiles, with the result that those involved are involuntarily made collectively “guilty” in the collective subconscious of public opinion, with the result that this popular public practice of the media thus eliminates any constitutional and legal safeguards for the rights of suspects, but with the consequence that, until the criminal case has reached its final stage, that is to say, during the pre-trial stage, whether or not criminal proceedings are ultimately brought, even if the case in question is brought to trial until the final judgment of acquittal or conviction, the alleged perpetrator will have suffered a substantially irreparable and irreversible moral injury, damage to his professional reputation and political damage to his constituency.

In other words, all the Members of Parliament of the New Democracy are unanimous. voted, in accordance with the dictates of their conscience, ultimately to let the truth shine, shedding light on the cases, but that this case should be the fountainhead of a fruitful debate, which should itself become the subject of a wide-ranging consultation on any amendment to the Rules of Procedure of the House, since there is now good reason for there to be a more detailed and case-by-case examination and refinement of each case file separately and not automatically, irresponsibly and automatically, that is, before they are indiscriminately subjected to the waiver of the immunity of Members of Parliament without any further action, thus giving rise to reasonable suspicions of at least a burdensome ‘guilt’, at least in the eyes of public opinion.

I therefore believe that the conditions are ripe to launch a serious, scientific and wide-ranging dialogue with a view to curing certain chronic shortcomings in the proper functioning of the Parliamentary process.

In the light of the above-mentioned complex case, in particular the new files concerning the OPEKEPE, it has been amply demonstrated that there is an essential difference between the existence of an alleged involvement of Members of Parliament in a criminal offence under investigation, by virtue of a file that has been drawn up, and the actual commission of that offence in the end.

The unavoidable need to amend these contentious provisions in the Rules of the House will also safeguard public opinion, which, unwittingly, is being created and carried by certain media, which distort objectively the reality, suppressing the truth in public, disparagingly perceiving citizens as an amorphous mass which thinks in a herd-like and unruly manner, being highly susceptible to dissent, deprived of the ability to discern reasonably.

It is desirable, after the possible consultation on the failures of the existing provisions of the current Rules of Procedure of the Parliament, to initiate a sincere dialogue, seen from a review perspective, in addition to the existing civil and criminal framework, so that a accurate one can be established, clear and definite legislative framework, which was intended to put the finger on the pulse of the types of tongues, by resolutely combating the spread of false news and the serial destruction of the fundamental rights of the accused (the presumption of innocence, etc.).), as it has been judged and defined by the Constitutional legal order, the European Convention on Human Rights and the case law of the Supreme Domestic and European Courts.

Charalambos B.
