The Union of Greek Public Prosecutors<\/b> denounces as institutional interference<\/b> the decision of the IACA<\/b> to resign the prosecutor of the Supreme Court in the bugging<\/b>.<\/p>\n

The debate surrounding the recent decision of the Athens Bar Association<\/b>, which provoked a intense reaction from the Hellenic Union of Public Prosecutors<\/b>, is evolving in high tones of institutional confrontation<\/b>. The latter argues for an action that exceeds institutional limits<\/b> and touches, in its view, on the impermissible interference in the functioning of Justice<\/b>, focusing on the phone tapping<\/b> case. At the centre of the controversy is the Prosecutor of the Supreme Court, Konstantinos Tzavellas<\/b>, who has been asked to resign due to his handling of the case<\/b>. The Union of Public Prosecutors argues that such interventions<\/b>, when they come from institutional bodies<\/b>, can disturb the institutional balance<\/b> and damage the authority of justice<\/b>. At the same time, it reaffirms strongly the principle of judicial independence<\/b> as the foundation of the rule of law. The case demonstrates once again the sensitivity of the boundaries between institutional control<\/b> and interference in the judicial function<\/b>.<\/p>\n

The Union of Greek Prosecutors<\/b>, in a statement, explicitly condemns the decision<\/b> taken by a majority of the Athens Bar Association<\/b> to submit a request for the resignation<\/b> of the Prosecutor of the Supreme Court, Konstantinos Tzavellas<\/b>, on the occasion of the handling of the phone tapping case,<\/b>as ProtoThema points out.gr.<\/p>\n

Direct and impermissible interference in the functioning of Justice<\/h3>\n

At the same time, the SCA notes that “the formulation of such a request, outside any constitutional and legislative framework, constitutes a direct and impermissible interference in the functioning of Justice, insults the institution and approaches the characteristics of a serious institutional aberration” and continues the Union:<\/p>\n

“The administration of justice is governed exclusively by the Constitution and the laws and is not subject to pressures or interference that attempt to influence judicial judgment or substitute for the institutionalized control procedures.”<\/p>\n

Furthermore, the SCJ notes that “such actions, especially when manifested by institutional collaborators of the Judiciary, directly affect its authority and disturb the balance of the functions of the State”.<\/p>\n

Closing its statement, the Hellenic Union of Public Prosecutors states that “the independence of Justice is non-negotiable and the Hellenic Union of Public Prosecutors will continue to safeguard it by any institutional means, supporting the officers of Justice, regardless of their rank, against any attempt to interfere or question their work”.<\/p>\n","protected":false},"excerpt":{"rendered":"
