{"id":4059,"date":"2026-05-05T12:27:00","date_gmt":"2026-05-05T09:27:00","guid":{"rendered":"https:\/\/en.tomanifesto.gr\/?p=4059"},"modified":"2026-05-05T12:27:00","modified_gmt":"2026-05-05T09:27:00","slug":"aade-for-tycheropoulou-the-post-is-headed-by-an-official-with-a-pe-degree","status":"publish","type":"post","link":"https:\/\/en.tomanifesto.gr\/?p=4059","title":{"rendered":"AADE for Tycheropoulou: The post is headed by an official with a PE degree"},"content":{"rendered":"<p>Clarification CAA on the <b>appeal<\/b> against Tycheropoulou.<\/p>\n<p>There is no question of <b>referral<\/b> of this <b>employee<\/b>to the abolished position of responsibility as of 1\/1\/2026, the <b>ADEA<\/b> said, in response to <b>publications <\/b>and reports in television broadcasts regarding the <b>appeal by the AADE<\/b> against the decision of the Athens Single-Member Court of First Instance, before which an employee of the former OPEKEPE and now the AADE, against her recall from the position of Head of the Internal Audit Department of OPEKEPE, and pointed out the following:<\/p>\n<p>&#8220;1. The AADE, as a public service, proceeds to <b>exercise legal remedies <\/b>and remedies in accordance with the legal procedure, which includes the relevant recommendation of its legal representatives and the State Legal Council (relevant to our 31\/3\/2026 briefing to the media). The exercise of legal remedies and remedies is both a <b>right and an obligation of the Agency,<\/b> to defend the public interest. Failure to take legal action, despite a positive recommendation to the competent departments of the ADA, raises the question of the disciplinary and criminal liability of the competent bodies of the Office. All the more so when the subject of the litigation, in cases of this nature, is the payment of sums of money from public funds, as in this case.<\/p>\n<p>2. Various <b>publications<\/b> and reports attempt to give the impression that the adoption of the <b>non-executory decision<\/b> of the Single Judge of the Court of First Instance in the case in question, which, it should be noted, was discussed before the <b>integration of OPEKEPE<\/b> into the AADE, implies that the AADE is obliged to reassign the official in question as head of the Internal Audit Department of OPEKEPE. That is incorrect, since that position of responsibility does not exist from 1\/1\/2026, after the integration of the OPEKEPE into the AADE, since the specific internal audit responsibilities were transferred to the existing Internal Audit Directorate of the AADE, which has been operating since the establishment of the Authority on 1\/1\/2017, and which, according to the AADE&#8217;s organisation, has always been headed by a university-educated employee (PE). Therefore, there is no question of reassignment of the said official to the abolished position of responsibility from 1\/1\/2026 onwards, but only of any payment from public funds to the said official, in the event of rejection of the appeals.<\/p>\n<p>3. The appointment of officials <b>to positions of responsibility of the Authority<\/b> shall be carried out through <b>open procedures,<\/b> in accordance with the conditions and criteria provided for in the Law and the Authority&#8217;s Statute. It is not legally possible to be appointed to a position of responsibility without full compliance with the legal requirements, nor is it possible to circumvent the selection procedure.<\/p>\n<p>From the above it is clear that <b>not taking legal action<\/b> in this case would constitute not only <b>preferential treatment,<\/b>but also grounds for seeking disciplinary and criminal liability from the competent bodies of the AADE for failing to take the necessary steps.<\/p>\n<p>The <b>ADEA<\/b> respects the rights of all <b>12,000 of its employees<\/b> and applies the institutional framework uniformly, based on the principles of equality, impartiality and non-discrimination, with the aim of ensuring the legality and proper functioning of the Administration. As a matter of course, it applies all <b>judicial decisions<\/b> from which it has an obligation to comply.
